Expert Witness

 

Mr Cowling is experienced in helping Solicitors prepare a strong case based on suitable referenced material.  He is proficient in discussing complex cases with Barristers, and in performing joint reports with other surgeons. His opinion is based on his clinical experience, peer reviewed research papers and clinical protocols, as well as his own experiences of the common cases he has been instructed on.

Enquiries

 

Upon enquiry, Mr Cowling will confirm that there are no conflicts of interest and will advise if a case is outside his area of expertise.  He will provide a time scale for reporting, and generally works to a maximum report turnaround of 4-6 weeks. Mr Cowling is happy to supply redacted sample reports, as well as references from previous instructing solicitors.

Once instructions have been received and terms agreed, Mr Cowling will read all material provided, including medical records, previous legal documents and examination findings.  He will ensure he has ascertained all the facts of the case and will produce a clear and precise impartial expert report based on his opinion and experience. Mr Cowling is well versed in stating if there is a range of opinion within reasonable surgical practice, and will attempt to appropriately reference this range. He will also attempt to provide an accurate prognosis for a client’s injuries, and report upon possible complications and any effect on professional activities in the future.

Mr Cowling has full secretarial support.  This means all bookings should be organised and timely, and reports are prompt and of top quality. Reports are available in paper or Word format. Should an examination of the client be required, Mr Cowling has access to various consulting rooms in North Yorkshire (see ‘Contact us’ section of website).  If required, he has experience of travelling to examine clients who are housebound. 

Should a meeting of experts, conference with Counsel, or Court appearance be necessary Mr Cowling will make all necessary efforts to meet his commitments. 

Mr Cowling is registered with the Information Commissioners Office (registration number ZA234894) and complies with all relevant data protection. Records are held in a secure location and electronic data is encrypted and password protected.  All records are either returned to the solicitors following use, or shredded when they are no longer required.
